Creation Things
1. INTRODUCTION
These Terms govern access to and use of the website and the purchase of products from Creation Things.
2. DEFINITIONS
"Business" means Creation Things.
"Customer" means any purchaser.
"Products" means all goods offered through the website.
3. ELIGIBILITY
Users must be at least 18 years of age or have parental consent.
4. ACCOUNT ACCURACY
Customers are responsible for maintaining accurate account and order information.
5. PRODUCTS AND SERVICES
Products are custom-made and manufactured on demand. Product availability may change
without notice.
6. ORDER ACCEPTANCE
Orders constitute offers to purchase. The Business may refuse or cancel orders at its
discretion.
7. PRICING, GST AND PAYMENT
Prices may change without notice. Payment must be received before production begins.
8. PRINT-ON-DEMAND MANUFACTURING
Products are produced after purchase. Production may commence immediately. Orders may
not be amended after production begins.
9. PRODUCT DESCRIPTIONS
Reasonable efforts are made to ensure accuracy; however, descriptions, images and
specifications may contain inaccuracies.
10. COLOUR, SIZE AND APPEARANCE DISCLAIMERS
Colours may vary due to monitors, printing methods and materials. Minor manufacturing
variations do not constitute defects.
11. SHIPPING AND DELIVERY
Delivery estimates are not guarantees. Delays outside the Business's control do not create
liability.
12. LOST, STOLEN OR DELAYED SHIPMENTS
The Business is not liable for delays caused by carriers, weather, industrial action, customs,
public emergencies or force majeure events.
13. RETURNS AND REFUNDS
Returns are governed by the Returns and Refunds Policy and applicable Australian
Consumer Law.
14. INTELLECTUAL PROPERTY
All artwork, designs, text, logos, graphics and website content remain the exclusive property
of the Business.
15. USER CONTENT
Any reviews, comments or content submitted may be used, reproduced and displayed by
the Business.
16. PROHIBITED CONDUCT
Users may not interfere with website operations, infringe intellectual property rights,
upload malicious content or engage in unlawful conduct.
17. THIRD-PARTY PROVIDERS
The Business uses third-party platforms, payment providers, fulfilment partners and
carriers. Their services are subject to their own terms.
18. DISCLAIMER OF WARRANTIES
Except as required by law, products and services are provided on an 'as is' and 'as available' basis.
19. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Business's aggregate liability shall not exceed
the amount paid for the relevant order.
20. INDEMNITY
Customers agree to indemnify the Business against losses arising from breaches of these
Terms.
21. FORCE MAJEURE
The Business is not liable for failures caused by events beyond reasonable control.
22. PRIVACY
Personal information is handled in accordance with the Privacy Policy.
23. TERMINATION
